THE CONTRACT
The person who signs the booking form does so on behalf of all the individuals included on it, and all are bound by these booking conditions. They accept these conditions on behalf of herself or himself and all other named persons on the Booking Form and acknowledges that she or he is authorised to accept these conditions on behalf of those they are booking for.
All persons named on the Booking Form, are hereafter referred to as "you". All tours described in any of our marketing collateral will hereafter be referred to as "tours". All bookings are made with Nature and Nosh Tours NZ Limited (trading as Nature and Nosh Tours), hereafter referred to as the "company", "we" or "us". No variation of these conditions may be made unless this is done in writing by a director of the company.
This contract represents your entire agreement with us. You agree that this contract does not transfer any rights or legal redress to a third party, except you as a participant. If any part of this contract is deemed invalid or impossible to implement according to the law, that part shall be composed according to the law in a way that expresses the intent of the parties in the best possible manner, while the rest of the contract shall remain valid.
RISK & EXCLUSION OF LIABILITY
There is an element of risk involved with any adventure activity. Risks in undertaking our activities include (but are not limited to): hypothermia, heat exhaustion, physical injury caused by environment i.e. rock falls, and physical injury caused by self i.e. falling over.
We strongly recommend that you purchase travel insurance prior to your trip.
By participating in this activity, you are expressly assuming those risks and responsibilities and are, to the maximum extent permitted by law releasing Nature and Nosh Tours NZ Limited, its officers, employees, directors, agents and any other person associated with us, from any liability, claims, loss, damages or expenses (whether direct, indirect or consequential, however arising) caused by any event including but not limited to: personal injury or death; property loss or damage; acts which may be construed as negligible or accidental; any other loss or damage. If for any reason this clause is found to be unlawful then any liability attached shall not exceed the NZD amount of the tour booking.
You accept that you have been advised to obtain adequate travel insurance for all persons named on the Booking Form.
The staff and management of Nature and Nosh Tours NZ Limited take all practicable steps to identify and minimise potential dangers.
In participating in our tours, you agree to the following conditions:
I agree that I must follow the instructions of Nature and Nosh Tours NZ Limited staff at all times; furthermore, I agree that if I am the adult accompanying any person under the age of 18 I must ensure that the underage person follows our instructions at all times;
My successors, executors and administrators are bound by the Booking Terms & Conditions.
I agree not to commence any litigation proceedings in any country in relation to the risks and liabilities set out above and to indemnify Nature and Nosh Tours NZ Ltd against any claims;
I confirm I am physically fit and have no medical conditions which could affect my ability to participate in any aspect of our tours;
I confirm I am aware that professional medical assistance may be difficult and/or take some time to access due to the remote areas in which we are traveling;
I consent to receive medical treatment in the case of injury, accident or illness during the activity and to indemnify Nosh Tours NZ Limited against any claims, costs or expenses in respect of the treatment;
TOUR CONFIRMATION
All Nature & Nosh Tours require a minimum tour number of four people to go ahead, and have a maximum group size of 10 people, EXCEPT for one day experiences which have a minimum number of two people to go ahead. Once your booking has been processed we will notify you in writing via email as to whether your tour dates have met minimum numbers and have been confirmed. If minimum numbers have not been met at time of booking, we will notify you when they have been reached. In the event that the minimum number is not achieved, we will contact you not less than 45 days prior to departure, with the following possible options:
a) The tour to continue as planned with the payment of the additional "Small Tour" fee. If additional people join the tour after this point, this fee will be refunded to you before the start of the tour;
b) The option to transfer to another tour date at no additional cost;
c) A full refund of your deposit.
Any tours booked within 30 days of the tour departure date are subject to third party availability.
PAYMENT
All prices quoted for Nature & Nosh Tours NZ Limited are in New Zealand Dollars (NZD) unless otherwise stated. All prices are inclusive of 15% New Zealand Goods and Services Tax (GST).
Bookings made more than 90 days before the start of the tour require a 20% deposit to secure with the balance due (on confirmed tours) 45 days out from scheduled tour departure.
Bookings made 90 days or less before the start of the tour require a 20% deposit, with the balance required 7 days after booking to secure your spot on confirmed tours. If minimum numbers have not been met, the balance is payable when these numbers have been achieved. (See TOUR CONFIRMATION section above).
BOOKING FEE
Please note that all tours booked online incur a booking fee of 1.5%. If you would like to email us instead, we can book you in from our end without incurring this 1.5% fee.
CANCELLATIONS & REFUNDS
All cancellations must be made in writing and emailed to
hello@natureandnosh.co.nz (effective from the sent date on the email). You are advised to call us directly if you have not received an acknowledgement that your cancellation notice has been received by us within 48 hours of sending.
Please note that we have committed costs to accommodation and other suppliers who rely on us for payment pre-tour.
Cancellation charges are as follows:
For Short Escapes (Guide Series):
More than 90 days before date of tour departure: NZ$100 of your deposit per person charge
Between 90-45 days before date of tour departure: NZ$200 of your deposit per person charge
Between 44-31 days before date of tour departure: NZ$200 cancellation fee, the balance of your payment will be held as a credit with Nature & Nosh for 12 months and is fully transferrable to another person at no charge.
Between 30-15 days before date of tour departure: 50% of total tour price will be charged. The balance (50%) of your payment will be held as a credit with Nature & Nosh for 12 months and is fully transferrable to another person at no charge.
Within 14 days prior to walk departure or after scheduled departure: 80% of total tour price will be charged. The balance (20%) of your payment will be held as a credit with Nature & Nosh for 12 months and is fully transferrable to another person at no charge.
For multi-day tours and custom tours:
More than 90 days before date of tour departure: NZ$100 of your deposit per person.
Between 90-45 days before date of tour departure: 50% of your deposit
Between 44-21 days before date of tour departure: 50% of total tour price
Within 21 days prior to walk departure: 100% of total tour price (no refund)
After scheduled departure: 100% of total tour price (no refund)
For one day experiences
48 hours or more before the start of the tour - 100% refund
Less than 48hours before the start of the tour - No refund
Nature and Nosh Tours Limited reserves all rights to alter, amend or cancel any activity at its discretion for (but not limited to) any of the following reasons: a) waterway, road or weather conditions; b) unsuitability of guest(s) due to reasons such as age, ill health, poor fitness, intoxication or any other reasons rendering a guest unsuitable or unfit to participate in the activity; c) any other circumstances which are beyond the reasonable control of Nature and Nosh Tours Limited.
COVID policy: Should travel restrictions be put into place that inhibit your ability to join an escape, tour or one day experience, any funds not already paid out to or tagged to our suppliers, contractors (less $100 processing fee for Nature & Nosh) at the time we are notified of your inability to travel, will be held as a credit with Nature & Nosh for 12 months and is fully transferrable to another person at no charge. The transferrable amount will vary depending on the notice and committed funds.
ITINERARY CHANGES
Due to operating a significant proportion of our tours outdoors, there are elements beyond our control. We will do our best to deliver the experience outlined in each tour. However, from time to time, there are factors and circumstances which may cause us and/or your guide to alter or change the tour. We will notify you as soon as possible of any changes necessary and all tours will proceed with adjusted itineraries. This includes walking tracks, accommodations, restaurants, etc. We will inform you of any changes as soon as we are aware of them. Complete trip details will be included in your complete itinerary information sent to you approximately 30 days prior to departure.
SPECIAL DIETARY REQUIREMENTS
At Nature & Nosh Tours we celebrate the diversity that is all things nature, this includes people. If you have any special dietary requirements , allergies or preference, we need to be informed at the time of booking. This is so we can plan and prepare to meet your needs. We hope to accommodate all special dietary requirements, however, if this is not possible we will inform you as soon as possible. We will be eating a variety of food products throughout the tour and all reasonable care and precaution will be taken in the storage, transport, preparation and cooking of the food.
HEALTH & MEDICAL
You must complete the health and medical section of the booking form and advise us fully of any medical history of heart or lung disorders, asthma or epilepsy, insulin or drug dependency, or any other known medical condition. By agreeing to these booking terms and conditions you confirm that you (or those you are booking on behalf of) are in good health for the activities which you are undertaking.
Our tour guides have the right to disqualify anyone, at any time, during the trip if he or she feels the guest is physically incapable and/or if a guests continued participation will compromise the safety or be detrimental to the individual involved or the group. Refunds are not given under such circumstances. If you are feeling unwell while on the tour, you agree that you will let the tour guide know immediately and will not participate in any activities whilst you are feeling unwell.
AGE
We generally do not allow children under 16 years of age on our guided walks, unless part of a custom or private tour . If you are over 70 years, please consult your doctor to check your physical fitness, prior to making your booking.
USE OF IMAGERY
Nature and Nosh Tours NZ Ltd reserves the right to use any photographic images or video of guests for promotion purposes. This may include but is not limited to images used online, in printed material or events.
PRE-TOUR INFORMATION
Once your booking has been completed, we will send you all pre-tour information. Please ensure you read this thoroughly, as it contains important information pertaining to packing, meeting times and arrangements, what to expect, walk information and track grading with required fitness levels, what is supplied, tour inclusions and other relevant information for the tour. You are responsible for ensure that you have appropriate hiking footwear and a clothing for the tour.
CHANGES TO BOOKING TERMS & CONDITIONS
Nature & Nosh Tours reserve the right to change the terms and conditions at any time without notification. All tours will be subject to the terms and conditions at the time of booking. As such, it is a requirement to read the full terms and conditions prior to completing the booking.
GOVERNING LAW
This website and all component parts, including these Booking Terms and Conditions are governed by the laws of New Zealand and you agree to submit to the exclusive jurisdiction of the Courts of New Zealand.
